Hedin LLP Secures Record-Breaking $2.7 Million Video Privacy Protection Act Settlement

Hedin LLP represents the plaintiffs in Kueppers et al. v. Zumba Fitness LLC, a class action lawsuit against Zumba Fitness LLC for violations of the Video Privacy Protection Act.

On August 20, 2026, the Honorable William P. Dimitrouleas, U.S. District Judge for the Southern District of Florida granted the plaintiffs’ contested motion to certify a class of 4,543 consumers who purchased the Zumba Basic 1 on-demand instructor training course and had their personally identifiable information (“PII”)  to third-party advertisers.

The court wrote that “Plaintiffs’ counsel at Hedin LLP is extremely well qualified to represent the Classes in this matter” due to the firm’s “skilled prosecution of the instant action up until this point” and appointed Frank S. Hedin and Tyler Somes as class counsel.

Approximately one week later, the parties announced a class-wide settlement.  The settlement provides a historic amount of relief to the certified class.  Defendant Zumba Fitness LLC has agreed to create a non-reversionary settlement fund of $2.7 million.  On gross basis, the settlement recovers $594 per class member—a figure ten times higher than any previous VPPA settlement.

Upon final approval of the Settlement, 1,917 class members (those whose PII was found in the records of a single advertiser) will automatically receive a cash award of $228.78; 2,493 class members (those whose PII was found in the records of two advertisers) will automatically receive a cash award of $457.56; and 133 class members (those whose PII was found in the records of three advertisers) will automatically receive a cash award of $686.34.

Hedin LLP looks forward to working with the settlement administrator to complete the notice plan, moving for final approval of the class-action settlement, and distributing the cash awards to the members of the certified class.
